There are a number of restaurants in many states in the USA that serve CBD-infused beverages. In a recent report, it was published that it is not a new thing in the USA where such beverages are being served in many renowned and popular cafes. However, all of these cafes must follow the rules and regulations set forth by the state and local jurisdictions at which they reside.
In California, the state has banned such beverages. No CBD-infused beverages, such as those which contain alcohol are no longer allowed to be served in cafes or restaurants in California. However, California is one of the states that made cannabis legal in the medical industry. Also in 2016, recreational cannabis was approved by the massive public vote. Despite being legal, cannabis-infused beverages are strictly banned in California, as per recent reports.
In 2014, California published a Farm Bill in which they utilized to start a pilot program on industrial hemp. However, it was not possible as the state didn’t have guidelines in place to prevent criminal activity in order for the program to start. According to the California Department of Public Health, CBD cannot be used as food ingredient or additive or in any other form of food. The hemp-derived CBD or any form of CBD will not be considered as food.
While the California Department of Public Health added this rule in their policy book. However, the state of California has yet to back the law. Accordingly, after establishing one law by state or any authority, other authorities have the power to scrutinize or question that law. In this case, no one from state has said anything against the rule, as California’s Alcoholic Beverage Control has prohibited CBD infused beverage.
According to recent reports, it will be much easier to reverse the rule in the case of non-alcoholic beverages. As of now, no restaurants or bars are serving CBD-infused drinks in California. Some of the bars in New York are experimenting with CBD-infused alcohol, as per the news by CNBC. However, it is too early to comment on the fact that whether they will be able to successfully serve it for a long time or not.
